The Court found the $30,000 payment was made in the context of settling relationship property obligations and does not presently operate as a set-off against the later costs judgment; Mr Clayton could not show a counterclaim now and therefore could not set aside the bankruptcy notice or obtain a stay; both applications were dismissed and costs awarded to Mrs Clayton.
