Section 162 of the Accident Compensation Act governs second-tier appeals on questions of law but does not preclude recourse to the general appeal jurisdiction in s72 of the District Courts Act for first-instance interlocutory appeals; however the District Court had no statutory or inherent jurisdiction to stay payment of entitlements under the Act (s84 does not apply and inherent powers are insufficient), and the District Court's stay of 19 February 2009 must be quashed; the High Court has jurisdiction to hear the interlocutory appeal and should do so urgently.
