On the balance of probabilities the Court accepted the treating surgeon's evidence that the May 2013 bowling incident initiated or was the significant contributing event to the left L4 PARS fracture such that the condition and the need for L4/5 fusion were causally connected to a covered accident and were not wholly or substantially the result of a gradual process; the review decision declining cover was quashed and ACC must fund the surgery.
