On the pleaded facts and agreed documents the claim against Mr Jefferson was reasonably arguable: there was an arguable assumption of responsibility and proximity such that a duty of care could arise (particularly in relation to advice after the mediation when Jefferson billed Williams), and it was not plain as a matter of law that certification by another lawyer under s21F necessarily defeats liability or causation; accordingly the strike-out application failed.
