The Court exercised its procedural discretion and refused to strike out the Belsham affidavit because its late filing did not prejudice VinLink and admissibility is for the trial judge; the Court found no settlement privilege over the 31 May meeting or 3 June letter because no dispute of a kind for which relief may be given existed at that time, so the challenged material was not inadmissible and could not be struck out.
