The Court refused to grant an extension of time because the defendant failed to lay a proper foundation: there was no affidavit explaining the delay or setting out an arguable defence, insolvency was not addressed, and the unexplained, substantial delay meant the discretion to extend time should not be exercised, so the late statement of defence was struck out.
