The Tribunal did not err in law in applying s200: the UNHCR recognition and records were circumstances existing prior to the prior determination and were not new cogent evidence that could not with reasonable diligence have been produced earlier; the Tribunal's finding that the claimant had made a deliberate tactical election not to disclose those circumstances was open on the evidence and not a legal error; accordingly there is no seriously arguable question of law and leave to appeal and leave for judicial review are refused.
