Defendant failed to establish a reasonably arguable case that the s21A settlement would cause serious injustice under s21J; evidence did not show significant mental impairment at mediation or procedural unfairness, the settlement was a reasonable compromise reached with legal advice, and the balance of injustice favors enforcement; therefore summary judgment for the unpaid balance was appropriate and should be granted.
