On the balance of probabilities the lazyman press-up performed under the physiotherapist's instruction and in her presence caused a hyperextension injury to Mr Lamb's cervical spinal cord which produced his ongoing myelopathy; the pre-existing multilevel cervical spondylosis was asymptomatic and did not wholly or substantially cause the incapacity, therefore the event constitutes a treatment injury and the Corporation's earlier decisions are quashed.
