    ST v Accident Compensation Corporation

    Citation
    [2016] NZACC 125
    Court
    District Court

On the balance of probabilities the combined opinion of ACC experts, the CAP and the MRI interpretation established that the appellant suffered pre-existing osteoarthritis related to bilateral hip dysplasia which was symptomatically aggravated but not caused by the 4 May 2013 accident; therefore ACC was not liable to fund the surgery and the appeal was dismissed; permanent suppression was not granted but interim suppression was granted for seven days to permit a focused affidavit.
