Balancing the relevant r 6.10 factors the court found Dr Whittingham is a vulnerable, elderly person whose privacy and protection from further trauma outweighs the limited public interest in disclosure of a 1955 trial transcript; accordingly the application for the transcript is refused for the remainder of her life, with release acceptable upon her death.
