The appeal was allowed because the appellant proved extenuating circumstances (trauma, eyesight problems and reliance on her physiotherapist) warranting acceptance of a late review application; however the substantive entitlement to ACC‑funded shoulder surgery was rendered academic by the operation being provided publicly and therefore must be pursued at Review if desired; leave to apply for costs is reserved.
