The filmed area was public road reserve and a relatively public part of a driveway with no high expectation of privacy; the surveillance did not amount to a highly offensive intrusion on an objective standard; accordingly there is no serious question to be tried on the tort of invasion of privacy and the balance of convenience and overall justice do not justify continuation of an interim injunction.
