On the balance of probabilities the evidence, particularly Dr Robb's contemporaneous examination and the documented inconsistencies in spontaneous behaviour, established that the appellant exaggerated his symptoms such that ACC was entitled to be not satisfied that his condition remained the result of the 1993 injury; the suspension of entitlements was therefore upheld.
