The Panel breached the Tender Rules by imposing a minimum price and declining valid bids on that basis without validating and individually evaluating those bids as required by the LAOR and the Panel's Terms of Reference; specific performance ordering the Panel to validate and evaluate Kainui's 1.30 ha bid in accordance with the Tender Rules is appropriate and granted on summary judgment for that bid; summary judgment is otherwise declined.
