Defendants were entitled to costs for both the leave to defend application and for resisting the liquidation application; the public interest exception did not preclude costs because the plaintiffs' interest was the private recovery of unsecured debts; costs were awarded at category 2B with allowance for second counsel; costs were to lie where they fell on the application to fix costs; and approved costs were ordered to be paid directly to Richina Pacific Ltd (Bermuda) which funded the defence.
