The Court concluded the evidence established that Mr Hunt was the source of the funds used to acquire the property and that John Hunt and Ms O'Carroll were not bona fide contributors; accordingly the limited forfeiture orders were incorrect and the entire net proceeds of sale of the farm and the remaining balance of the TSB account were forfeited; certain other orders and the pecuniary penalty were set aside by consent and costs were to be paid from forfeited property.
