The High Court held the District Court judge correctly found actus reus and mens rea for the threatening offence and gave sufficient reasons, so the conviction appeal was dismissed; however the District Court erred in refusing a discharge under s106 because credible fresh evidence showed the real and appreciable adverse consequences for international travel would be out of all proportion to the very low gravity of the offending, so the conviction was quashed and a discharge without conviction ordered.
