The Court found that imposing the mandatory third strike sentence of 14 years (especially if ordered to be served without parole) would be so disproportionately severe in the applicant's circumstances that it breached s 9 NZBORA; accordingly the Court imposed the 'but for' sentence it would have imposed absent the three strikes regime: total imprisonment of five years and one month with a minimum period of two years, concurrent sentences for other counts, and driving disqualification of three and a half years starting on release.
