The Family Court correctly found, on uncontradicted medical and social evidence, that the child was a child in need of care and protection (serious risk arising from feeding/nutrition issues and inability of caregivers to follow agreed medical plans); no practicable or appropriate alternative under s73 existed; the s39 place of safety warrant and subsequent interim orders were lawful; the Family Court's decision to make a s101 care and protection order (to be formalised) was a final decision subject to appeal and is affirmed; appeal dismissed.
