The Court will appoint a pūkenga where questions of tikanga arise; the primary qualification is relevant knowledge and lived experience of the tikanga of the application area, and strict independence from parties or ownership interests is not a prerequisite when the pool of suitable experts is limited and expertise is tied to the area; Ms Jane Davis's ownership interest does not render her appointment inappropriate though it may affect the weight of her advice and is open to challenge, cross-examination or supplementation by parties.
