The Court held s146 is triggered where, within three months of a valid review application, no hearing date was set to consider the substantive review; a hearing convened solely to decide jurisdiction did not satisfy s146. Mr Carter erred by setting only a jurisdictional hearing. Consequently the appellant is entitled to a deemed decision in his favour under s146.
