Because no real prejudice would result and the court must accommodate realistic case management and respondent resource constraints, the court granted a limited extension and directed the respondent to file submissions by 30 May 2014, preserving the ability for further directions if necessary.

The High Court exercised its case management discretion to issue specific pre-hearing directions: allocate two days' hearing time, fix costs category 2B, refuse security for costs given three related appeals, require provision of the Weathertight Homes Tribunal transcript and impose a detailed timetable for points of appeal, bundle preparation, filing of submissions and responses, with equal sharing of reasonable bundle preparation costs.

Because the proceeding was stayed the Court could not entertain the strike out application except insofar as it related to lifting the stay; Mr Heenan's failure to file a compliant notice of opposition meant he was not entitled to be heard on the unopposed application; r10.22 did not justify appointing counsel assisting to represent a civil litigant; defendants were granted leave to amend their application to include an application to lift the stay and a timetable and directions were issued.
