Because the appellant continued to engage in the employment of the New Zealand Defence Force (albeit restricted duties) until the week ending 4 July 2002, he was not legally incapacitated before that date under s103(2); his legal incapacity commenced when his employment ceased on 4 July 2002, he was an earner immediately before that date, and therefore entitled to weekly compensation from the commencement of his incapacity assessed under Schedule 1 Clauses 33 and 34.
