The application for security for costs was dismissed because PSDL demonstrated at least a prima facie entitlement to a refund of the Lot 22 deposit which alone exceeded the security sought, and because the merits and substantial uncertainty about forfeiture of other deposits meant it would be unjust and disproportionate to require PSDL to provide security.
