The applicant established an arguable and substantial dispute about the genuineness of the 27 August 2010 transfer document (including the signature and witness), and that dispute could not be fairly resolved on affidavit evidence; accordingly the statutory demand had to be set aside to avoid injustice and permit full evidence at trial.
