The plaintiff's summary judgment application was materially flawed and lacked sufficient merit, justifying increased costs (2B plus 50% uplift) to compensate the defendants for the additional work required; however the high threshold for indemnity costs under the interpretation in Bradbury v Westpac was not met, so indemnity costs were refused.
