The phrase 'and attested by us in his presence' in the attestation clause constitutes a statement by each witness that the document was signed by the will-maker in their presence and therefore satisfies s11(4)(b) of the Wills Act 2007; accordingly the registrar's conclusion that the attestation clause was defective was incorrect and the review is allowed, with the matter referred back to the registrar for further consideration.
