Scale costs were awarded and a 20% uplift applied to most items because the defendants' conduct unnecessarily increased time and expense; band C rates were adequate for briefs of evidence and trial preparation so the 100% uplift sought for those items was declined; disbursements were allowed but the largest expert fee (forensic accountant) was reduced from the claimed amount to an amount the Court found reasonable (NZD 175000); the court ordered payment of the applicant's costs and disbursements and that the former litigation guardian's costs be paid from the minor's trust.
