The medical evidence, particularly the multidisciplinary Clinical Advisory Panel opinion supported by imaging and the appellant's prior history of chronic shoulder symptoms, established that the rotator cuff pathology was more probably the result of progressive degenerative tendinosis and not substantially caused by the single accident; accordingly ACC correctly declined surgery and weekly compensation under s26, and leave for the late appeal was refused for lack of merit and inadequate explanation for delay.
