Unchallenged specialist medical evidence established no identifiable personal injury caused by treatment; the appellant's infections, pain and complications were ordinary or known risks of BCG and stent placement and the management met accepted standards, therefore the criteria for a treatment injury under s32 were not met and ACC's decline of cover was upheld.
