The 2005 covenant was varied to the minimum extent necessary to allow the applicants to comply with the 2010 covenant and Environment Court consent RMA92015049, subject to detailed terms limiting planting areas, species and tree heights and requiring removal and mitigation steps; the Court could not vary the 2010 covenant or the Environment Court consent and refused to reserve leave to seek future compensation.
