Leave to appeal was dismissed because even if trial counsel erred in not advancing a direct credibility challenge, that tactical decision did not give rise to any plausible risk of miscarriage of justice in the factual context of this case.

The Court held the decision not to call the son and to agree to the ERI edit were reasonable tactical choices after proper consultation; the risks of calling the son (potentially corroborative but also potentially harmful evidence and contradiction with other defence witnesses) outweighed any benefit, counsel acted competently, and those decisions did not produce a miscarriage of justice, so the convictions stand even though further affidavit evidence was admitted on appeal.

The application for leave is dismissed because the proposed appeal would require this Court to reappraise the Court of Appeal's factual judgments, raises no issue of principle and does not disclose an arguable miscarriage of justice, and therefore fails to meet the statutory requirements for leave to appeal.
