Leave to appeal was refused because, although the proposed appeal raised a question of law capable of bona fide argument, it was not of sufficient importance to outweigh the additional cost and delay and prejudice to Mrs Harrison; the combination of s25(3)/(4) and s33 permits the interim distribution/vesting ordered, the trust debts were properly treated as relationship property for interim distribution, and the respondent's evidence of inability to pay was unconvincing.
