The Court held Mr Macnamara was the unsuccessful party on the interlocutory application; trustees were entitled to their costs and disbursements ($10,881.96) and Ms Macnamara was entitled to costs fixed on a 2B scale ($27,007) uplifted by 50% under r 14.6 because Mr Macnamara unnecessarily advanced peripheral and meritless arguments and failed to confine himself to the issues before the Court, resulting in a costs award to Ms Macnamara of $40,510.50 plus disbursements of $11,842; expert fees claimed were allowed as necessary to meet the opposition evidence.
