The widow's claim, though arguable and supported by opinions, was not strong and ran against the clear wording of the Will; the disputed issue arose because of the beneficiary's position rather than inevitably from trust administration, therefore costs follow the event: the unsuccessful beneficiary (first defendant) must pay the successful beneficiaries' costs while the trustees' costs are to be met by the estate.
