Because Mr Time's successful application produced significant benefit to the Trust Board and Mr Fagalilo's opposition was found unjustified, the court ordered the Trust Board and Mr Fagalilo to be jointly and severally liable for the costs award of $40,000 plus disbursements; separately, Mr Time must personally pay the costs of his unsuccessful recall application payable to Mr Fagalilo.
