The interim injunction was discharged because the defendants demonstrated a reasonable possibility of establishing defences of truth/unlawful conduct and/or theft at trial such that the high Fahey threshold for prior restraint was not met; consequently continuation of the prior restraint could not be justified and the balance of convenience is irrelevant.

Some comments by NZICA's acting CEO at May 2013 conferences were defamatory in meaning, but CPAA, as a corporate plaintiff, failed to prove pecuniary loss under s6 Defamation Act and therefore is not entitled to relief; NZICA's defences of truth and honest opinion were not established for the key sting and qualified privilege was narrowly denied because the speaker took improper advantage of the privileged occasion; parts of the May 2011 flyer were misleading under the FTA but CPAA failed to prove pecuniary loss under the FTA so no relief granted.

Leave to appeal was dismissed because the principal differences between the High Court and Court of Appeal were factual; the legal questions advanced were fact‑dependent and not of general or public importance; there was no appearance of a substantial miscarriage of justice, and the Court of Appeal correctly concluded the words did not bear the pleaded defamatory meanings and that available defences and relief rulings were properly determined.
