The claim was properly struck out because the statement of claim disclosed no reasonably arguable cause of action: the first respondent's emails were communications to council about an observed obstruction and were protected by qualified privilege (and likely true), and allegations against the second respondent amounted to purported perjury which is not a civil tort and would require a private prosecution under the Criminal Procedure Act; accordingly the strike-out was appropriate.
