The deceit claim based on the deceptive telephone call succeeded for proven economic loss of $131.28; exemplary damages were refused because there was no subjective appreciation of a risk of harm or conscious recklessness; no arbitrary detention under s22 was made out; the trespass claim failed because the police were the undisclosed principal to the licence agreement and thus had access rights; and no s21 breach arose because the complainant had no reasonable privacy interest in the contents of the undercover officer's unit.
