Section 40 is unambiguous and requires the respondent to calculate weekly earnings using the four weeks immediately before the commencement of incapacity divided by the number of remunerated full or part weeks; applying that rule the respondent's assessment of $94.82 was correct and there was no question of law for the High Court.
