The Court was satisfied on the material that there are reasonable grounds to believe the respondent unlawfully benefited from significant criminal activity (supply of methamphetamine), that he has an interest in the two Harley Davidson motorcycles, and therefore made restraining and further orders to preserve the property and enable enforcement by the Official Assignee, by consent.

Because the Court was satisfied on the material before it that there were reasonable grounds to believe the property was tainted or the product of unlawful gain, that the respondent had an interest in it, and that giving notice created a real risk of disposal or value alteration, a without-notice restraining order was justified and was made in terms of the draft filed.

The Court was satisfied there were reasonable grounds to believe JET205 and the proceeds from GBF943 were tainted or represented unlawful benefits from significant criminal activity given intercepted communications, tracking data, the discovery of a large cash cache, and circumstantial evidence that JET205 was left as security for drugs; accordingly restraining orders were justified and the Official Assignee was authorised to sell JET205 with priority payment to UDC up to the registered debt and remaining proceeds held pending resolution.

The police search evidence and the respondent's admissions gave reasonable grounds to find unlawful benefit from sustained manufacture and supply of methamphetamine; that finding satisfied the statutory threshold for restraint and profit forfeiture, and the court therefore granted a restraining order, an associated sale order and a profit forfeiture order to apply proceeds including seized cash and sale proceeds to satisfy the forfeiture.
