The court allowed recovery of the filing fee and reasonable compensation for time the non-party was required to spend complying with discovery, but disallowed disbursements claimed for assistance from a non-lawyer litigation support provider; accordingly the plaintiff was ordered to pay $110 (filing fee) and $705.25 (costs) to the non-party.

The convictions were upheld because the guilty pleas were voluntary, supported by evidence and did not produce a miscarriage of justice; the six month home detention sentence was within the acceptable range for the offending, was not manifestly excessive and met sentencing purposes, therefore the appeal against conviction and sentence is dismissed.

The Court found the debtor's annulment application lacked merit and was pursued in a manner that unnecessarily increased the creditor's costs and that the debtor failed without reasonable justification to accept clear legal arguments; accordingly indemnity costs were justified under r 48C and awarded to the judgment creditor in the amounts specified.
