Resignation and appointment under s283(2) are ineffective until notice is lodged with the Registrar; because Mr Norris was convicted before lodgement a vacancy arose and the Official Assignee validly appointed the applicants; s281 does not validate a private purported appointment after a vacancy caused by conviction; accordingly Churchill was never liquidator and the ex parte search order obtained by the applicants was valid and is not to be quashed.
