On the balance of probabilities the Court found Bartlett engaged in commercial cannabis cultivation and sale during the analysis period beyond the crops discovered by police; unexplained cash flows and expenditure combined with circumstantial and direct police evidence established that specified assets (Chevrolet, McLay boat and trailer, Polaris ATV) were acquired at least in part with proceeds of that criminal activity; under s50 the Court was obliged to make assets forfeiture orders; profit forfeiture based on the destroyed 2014 crop was not appropriate because unrealized/destroyed product…
