The Court held the Parole Board was required to apply the 'undue risk' test when deciding whether to vary or discharge special parole conditions and must assess both likelihood and nature/seriousness of reoffending using contemporaneous and relevant evidence; the Board failed to engage adequately with up‑to‑date community risk assessments and therefore acted unreasonably, warranting quashing of its decision and remittal for reconsideration in light of current evidence.
