The application was dismissed because key categories of documents sought did not exist beyond 28 January 2016, the documents and claims produced by Rintoul (diary entries and payment claims) were sufficient to show completion by end January and did not support the Council's contention of further work or additional costs after that date, and the additional detailed material sought (metal delivery records, work sheets for variations, provisional sum documentation) was not necessary to resolve the pleaded issue of whether substantive work and costs extended beyond January 2016.
