KW v Accident Rehabilitation and Compensation Insurance Corporation
- Citation
- [1997] NZACC 66
- Court
- District Court
The Corporation's decision was revoked because it failed to give sufficient weight to pain-related impairment and did not properly investigate the two central questions of (a) whether the appellant is permanently unable to drive due to her injury and (b) whether her disability is causally attributable to the 1978 accident; the matter is remitted for further enquiries including independent medical and driving assessments and a reconsideration giving due weight to those findings.
