GAUTAM JINDAL v ORANGE CAPITAL LIMITED (IN LIQUIDATION) [2023] NZSC 36
- Citation
- [2023] NZSC 36
- Court
- Supreme Court
Leave to appeal was dismissed because the applicant's grounds did not meet the Senior Courts Act 2016 s 74(2) criteria: the liquidator's claim was properly characterised as a debt claim within District Court jurisdiction and not a s 292 voidable transaction; the contested evidence was not expert evidence requiring cross-examination; and the minimum wage claim failed because no salary had been authorised under s 161(1) Companies Act 1993, such that there was no issue of general or public importance nor any miscarriage of justice warranting leave.
