The application is justiciable but fails on the merits because Gama did not establish the existence of an unlawful unwritten practice not to prosecute; MSD's contemporaneous policies, procedures, investigative steps and Recovery and Response Panel demonstrate prosecutions were contemplated and pursued lawfully and there was no legal error in MSD's approach; the judicial review is dismissed.
